Terms of Service
Effective: September 4, 2025
Thank you for using MethodicalFunction ("MethodicalFunction," "we," "us," or "our"). These Terms of Service ("Terms") are a binding agreement between you and MethodicalFunction that governs your access to and use of MethodicalFunction.com (the "Site") and any content, code samples, RSS feeds, and features we provide (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) Who May Use the Services
You must be at least 13 years old. If you are under 18, you may use the Services only with the consent of a parent or guardian. We do not knowingly allow users under 13.
2) Content and License to You
Unless stated otherwise, the articles, tutorials, designs, diagrams, and other content on the Site are copyright © MethodicalFunction. Code snippets and example projects are provided as-is for educational purposes without warranty. Where explicitly marked, certain code may be licensed under an open-source license; otherwise, you receive a limited, revocable, non-transferable license to view and use the content for personal or internal business use.
You may not copy, reproduce, publicly display, distribute, or create derivative works from our content except as permitted by law (e.g., fair use) or by a specific license notice on the page.
3) User-Generated Content (UGC)
We may enable comments via Giscus (which uses GitHub Discussions). If you post content:
- You represent that you own or have rights to it and that it is lawful and non-infringing.
- You grant us a worldwide, royalty-free license to host, display, and distribute your UGC in connection with operating and improving the Services.
- Comments are public; do not post confidential or personal information.
We reserve the right (but have no obligation) to moderate, remove, or refuse content at our discretion.
4) Acceptable Use
You agree not to: (a) misuse, attack, or disrupt the Services; (b) scrape or crawl at rates that impair performance; (c) reverse engineer components except as allowed by law; (d) upload malware; (e) infringe intellectual property or privacy rights; or (f) use the Services for illegal, deceptive, or harmful purposes.
5) Third-Party Services; Affiliates; Ads
We may link to or integrate third-party services (e.g., Google Analytics, GitHub, YouTube). Those services are governed by their own terms and policies. We may display advertising or include affiliate links (including Amazon Associates). We may earn commissions from qualifying purchases. Sponsored content will be labeled.
6) Educational Content; No Professional Advice
Content is for educational purposes only and does not constitute professional advice. You are responsible for evaluating and testing any code in your environment.
7) DMCA / Copyright Complaints
If you believe content infringes your copyright, send a notice to legal@methodicalfunction.com with: (i) identification of the work; (ii) the URL of the allegedly infringing material; (iii) your contact info; (iv) a statement of good-faith belief; (v) a statement under penalty of perjury; and (vi) your physical or electronic signature. We may remove content and, where appropriate, terminate repeat infringers.
8) Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.
9) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, METHODICALFUNCTION AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED $1.00.
Some jurisdictions do not allow certain limitations; in those cases, the above limits apply to the fullest extent permitted.
10) Indemnity
You agree to indemnify and hold MethodicalFunction and its contributors harmless from any claims, damages, liabilities, and expenses (including attorneys' fees) arising out of your use of the Services or violation of these Terms.
11) Governing Law; Venue; Arbitration; Class-Action Waiver
These Terms are governed by the laws of California, excluding conflicts of law rules. Except for small-claims matters, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration before JAMS under its consumer rules. Venue will be Sacramento County, California. Class actions and class arbitrations are waived; disputes must be brought individually.
Opt-out: You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing legal@methodicalfunction.com with subject "Arbitration Opt-Out."
12) Changes to the Services and Terms
We may modify the Services and these Terms. If changes are material, we will update the "Effective" date and, where appropriate, provide a notice. Continued use after changes means you accept them.
